Celebrating Memorial Day

BUTLER, Mo – Memorial Day is a federal holiday in the United States for remembering the people who died while serving in the country’s armed forces.

The holiday, which is observed every year on the last Monday of May, was formerly known as Decoration Day and originated after the American Civil War to commemorate the Union and Confederate soldiers who died in the war. By the 20th century, Memorial Day had been extended to honor all Americans who died while in the military service. It typically marks the start of the summer vacation season, while Labor Day marks its end.

Many people visit cemeteries and memorials, particularly to honor those who have died in military service. Many volunteers place an American flag on each grave in national cemeteries.

Memorial Day is not to be confused with Veterans Day; Memorial Day is a day of remembering the men and women who died while serving, while Veterans Day celebrates the service of all U.S. military veterans.

James Barton Horn Fatally Shot by Major Case Squad

Police say a Rural Missouri Major Case Squad team fatally shot James Barton Horn, who was accused of holding his girlfriend captive for four months and then killing her and her teenage son after she escaped.

Clinton, MO, police said Horn was found in an abandoned home in the Kearn Memorial Conservation Area located off of Hope Dale Road about 11:15 a.m Saturday morning. The conservation area is very large and covers both Pettis and Johnson County, MO. The house’s locations was about a half mile from the Pettis County line in Johnson County.

Lt. Sonny Lynch with the Clinton Police Department said, based on some leads that came in Friday night, a search team for the Rural Missouri Major Case Squad entered the home and found Horn in a closet.

He was armed, refused to surrender and threatened the search team with his weapon. They responded by shooting him. He died on scene.

Authorities believed Horn was armed and dangerous and had previously said they thought a friend or family member was helping him stay hidden.

Horn was accused of holding Sandra Sutton captive for four months, including forcing her to live in a wooden box and sexually assaulting her. Sandra Sutton, who had declined police protection, was living with her brother and sister-in-law in Clinton. Her son was a junior at Clinton High School, and his sister said he stayed with his mother in an effort to protect her.

The Sutton family was notified of Horn’s death.

The Kearn Memorial Conservation Area is owned by the Missouri Department of Conservation. It’s a fairly large public land that people use for outdoor recreation like hunting, fishing and hiking.

According to court records, an arrest warrant was issued Thursday afternoon for 34 year old BillyW Willett, of Fort Scott, KS for Assault – 2nd Degree, and Resisting/Interfering With Arrest.

According to the Vernon County Sheriff’s Office, the vehicle driven by Willett turned off of 54 Hwy when the deputy activated his lights, but instead of stopping, took off, drove through a stop sign and pulled back onto 54 Hwy in front of an oncoming Semi causing the semi to hit Willetts car.

Update: Double Homicide Suspect James Horn Still at Large - Be On the Lookout.

SEDALIA, Mo. – Police in multiple states will continue searching for double homicide suspect James Horn on Friday.

Horn is the suspect in a double homicide that happened Thursday morning. Sandra Kay Sutton, 46, along with her 17-year-old sun Zachary Wade Sutton, who were found dead in Clinton on Thursday. Sandra Sutton was the woman Horn is accused of locking up in a wooden box for four months.

Sedalia Police Chief John DeGonia said Friday morning that extra patrol cars are still on the scene at E. 15th Street in the city and would remain there until Horn is caught.

Preliminary autopsy results are expected Friday for the two victims. The autopsies are being conducted by the Jackson County Medical Examiner.

Sedalia, Mo., police searched multiple homes in Horn’s neighborhood, but were unable to track him down. The victims were found just before 4:30 a.m. Thursday at 7176 E. Franklin Street in Clinton, Mo.

Horn, the man accused of kidnapping and locking Sutton up in the box, is the suspect in the case, according to the Clinton Police Department. He is a white male, roughly 6/0” tall and weighs 180 pounds. He has brown hair, brown eyes and an average build. Horn is considered armed and dangerous.

NEW | James B. Horn, Jr.’s lengthy history of sexual violence and prison time

Sonny Lynch, assistant chief of police for the Clinton Police Department, said the son was found on the stairs and Sandra Sutton was discovered in a bedroom. “They were discovered by family members who were working on the overnight shift,” Lynch said. “They had been away working when this happened.”

Lynch said he doesn’t know of any signs of forced entry at the home where Sutton and her son were found shot dead. Police believe Horn killed them and then fled to the home in Sedalia where Sutton told police Horn held her captive. Authorities surrounded three homes, including Horn’s home, in Sedalia Thursday in their search. At 4 p.m. on Thursday, SWAT teams had searched the homes and found no sign of him. He is still at large.

In the immediate aftermath of the homicides, some wondered why the family was not under some type of protection. On the issue of police protection for Sutton following her escape, Lynch said the police department was unaware she lived in Clinton after Sutton and her son moved in with her brother. “We did not know she was living in our community,” Lynch said. “We’re still investigating those details. We were not notified that she was in our community.”

According to Lynch, victim advocacy groups in both Sedalia and Clinton recommended to Sutton that she should get protection from police.

However, she said no, Lynch said. “She was advised by victim advocates to get a protection order,” he said. “She felt she was safe. She did not want to take that advice.”

Lynch added that he’s unsure if the protection order would have made a difference in this case. Horn was aware of the home’s location because they all worked together. Horn knew which family members worked which shift, Lynch said. After the murders, police believe Horn stole the car located at the home in Clinton.

Autopsies will be done by the Jackson County medical examiner. Preliminary results are expected Friday, and toxicology reports are expected in six to eight weeks, authorities said during an afternoon news conference in Clinton. More than 30 investigators were on the scene in Clinton.

Sedalia police surround homes

Sedalia police blocked off a home on the 800 block of E. 15th Street, the location of Horn’s home where he kept Sandra Sutton locked up in the box. Police arrived at Horn’s home around 5:30 a.m. Thursday. Several times, police requested Horn to come out with his hands up. They never received a response.

Other nearby homes were also searched. A robot and a SWAT team took down the front door of another home where Horn was thought to be at about 2:30 p.m. and went inside. The home turned out to be vacant. As of 4pm Thursday, SWAT teams cleared the three homes, including Horn’s, and didn’t find him. No other suspects have been indicated at this time, police said during an afternoon news conference.

The original case

Police in Sedalia have been looking for Horn since May 1, a day after Sandra Sutton escaped the box and contacted police with the help of a neighbor. The initial call from her came at around 6 p.m. on April 30.

Police described the call as “hysterical,” but said Sutton had calmed down by the time they arrived at the home. She told police Horn locked her in a wooden box for the past four months. When investigating Horn’s home, police discovered a box similarly to one described by the victim.

Horn had a criminal past

This was not Horn’s first run-in with the law. He spent over a decade in prison for kidnapping and raping his wife. He had also spent three more years in a prison for raping and kidnapping a second woman he had previously dated for five months. Horn was released from prison in December 2011.

Due to the nature of his crimes, he was supposed to be supervised release by law enforcement and he was required to register as a sex offender.

Previously in this case, prosecutors charged Horn with kidnapping, armed criminal action and unlawful use of a weapon.

Gas Prices Set to Fall

NEW YORK (CNNMoney) – Gas prices have been steadily climbing, but with the summer driving season starting with the Memorial Day weekend, drivers could soon begin to see some relief at the pump.

“Everything points to the notion that we are very close to a peak price of 2015,” said Tom Kloza, chief oil analyst for the Oil Price Information Service, which tracks prices for AAA, as well as GasBuddy.com

The average price of a gallon of regular gas heading into the weekend stood at $2.74, the high point so far this year. That’s up 25 cents a gallon over the last month, but it’s still about 90 cents a gallon cheaper than gas was a year ago.

The 33-million Americans that AAA are likely to be taking a car trip this weekend will find the cheapest prices for this holiday weekend since 2010.

Kloza said much of the recent run-up in prices has been due to the normal seasonal shutdowns of refineries as they stop producing winter blend gasoline and prepare to start making the more expensive summer blend required to reduce smog and air pollution. But most of that changeover is now complete, and supplies of gasoline should start to build from this point on, he said.

“Prices have been strong enough that most of the refineries are hurrying to restart,” Kloza said.

So as supplies rebuild, that should mean gas prices falling to near $2.50 a gallon by July or August, he predicted. And once the summer driving, and summer blend of gasoline ends, prices could fall sharply at the end of the year as they did last year, Kloza predicted.

“Post-Labor Day, a lot of places are going to see gasoline for $2, 2.25 a gallon,” he said.

Crude oil prices were also climbing much of this year, helped by the a slight weakening of the dollar in recent months. Some other countries including China have been buying oil to fill their own strategic petroleum reserves, helping demand.

But Kloza and some other experts believe the recent rally in oil prices could be running out of steam. Factors that drove oil prices lower late last year, including increased U.S oil production, could start to put downward pressure on crude in coming months.

“We believe that the recent price rally is premature,” wrote Goldman Sachs oil analysts Damien Courvalin and Jeffrey Currie in a note this week. They’re expecting prices to revisit recent lows of $45 a barrel by October.

Butler HealthMart Pharmacy Prescriptions

BATES COUNTY : The News Room of FM-92 reaches out to our community regarding Butler HealthMart Pharmacy. Owner Dave Childers has posted a sign on the door of Butler HealthMart Pharmacy located at 11 South Orange Street in Butler last week. The sign states that they are closed due to illness.

FM-92 was unable to contact Pharmacist, Mr. Childers. After long lines kept Wal-Mart Pharmacy Customers waiting to fill prescriptions for hours… Wal-Mart passed out water and mints to those waiting to have prescriptions filled. Fm-92 talked with Pharmacist Georgia Keiser of Adrian Kreisler Drug and Floral Pharmacy .. Ms. Keiser suggested all patients contact their Doctor and have their Prescriptions transferred to the Pharmacy of their choice. Walmart commented to FM-92 News, that they have hired additional staff and suggest that you call before you come to Walmart, so prescription wait time is shorter. Doctors are transferring all prescriptions to the Butler Walmart Pharmacy unless you state otherwise. We hope to have additional information regarding Butler HealthMart Pharmacy as details develop.

Home Stretch in Sight

BATES COUNTY, Mo – The home stretch is in sight. The Butler Pool will open Saturday May 23rd for the 2015 swimming season and the Bates County Youth Advocacy Council still has 30 children on their list that will not be able to enjoy swimming this summer without your help.

Sometimes the question arises, why should I donate to the Pool Pal Program, they aren’t my children. If it takes a village to raise a child then perhaps it’s your opportunity to do something for a child that would otherwise not be able to enjoy fun that other children sometimes take for granted.

Donations in any amount will be appreciated from $5.00 to sponsoring an entire family. The Pool Pal Program combines donations to insure that many children will benefit. Let’s not get this close and not cross the finish line.

If you are interested in donating money to the Pool Pals Program, mail your donations to:

McGennis Youth Center Needs Lifeguards

The opening of swim season at the McGennis Youth Center has been delayed. Traditionally swimming has opened at the Center on the Saturday of Memorial Day weekend. But this year the Center has been unable to find lifeguards.

The Center’s Board of Directors is still seeking lifeguard applications, and swimming will open when and if lifeguards can be hired.

If you are a certified lifeguard or know someone who is and would like part-time summer employment, contact the McGennis Youth Center at 417-484-3216. Also, if you are a strong swimmer and are interested in becoming certified, you should contact the Center.

While the swim season is delayed, the rest of the McGennis Youth Center is open and offers a variety of outdoor recreational facilities: two shelter houses for picnics and cookouts, four cabins for camping, tennis, basketball and volleyball courts and fishing.

Use of the camping cabins for groups and organizations is on a donation basis. For individuals wanting to use the cabins, the fee is $20 per night. Cabins can be used by individuals for a maximum of seven nights. The Center also has two camper electricity hook-ups at a fee of $20 per night.

Rain, Late Corn Planting Delay Soybean Planting

COLUMBIA, Mo. – Rain over Memorial Day weekend likely means that Missouri farmers will shed planting equipment again for the third weekend in a row.

Delays in corn planting have pushed soybean planting progress well below the five-year average. Soybean planting generally does not begin until corn planting is complete.

Eighteen percent of the state’s corn crop remains to be planted, according to the May 18 USDA crop progress report. Soybean planting is 16 percent complete in Missouri, woefully behind this time last year and the five-year average of 27 percent. Last year, 30 percent of the state’s 5 million acres of soybean was in the ground.

Row crop planting slowed last week as storms moved through the state. Rain averaged 2.43 inches statewide, with some parts getting up to 5 inches.

Studies show that earlier planting and higher yields go hand in hand most years. Soybean yields decrease 4 percent when not planted by mid-May. By the end of May, yields drop by 10 percent. That is significant, but not as important as the long-term damage to soil that working wet fields can cause. Soil conditions, rather than calendar date, dictate when to plant.

Planting date of soybean affects yield less than environmental conditions in August, he says. Conditions during the first two weeks of August govern soybean pod and seed development, which are determinants of yield.

Conditions across the state vary greatly. Fewer soybeans have been planted in the western part of the state where heavy rains have hit. Only 7 percent of the soybean crop is planted in northwestern Missouri and only 56 percent of the corn crop there is in the ground.

Down Go the Houses…Finally

BUTLER, Mo – A collective cheer went up at the Butler City Council Meeting Tuesday evening as the report of a total of 9 houses has now been demolished. After several years of working through all the red tape and dealing with different agencies, it was welcome news to the Council.

Susan Anderson and Myrtle Patrick asked permission to hold a 5k run for the Butler Saddle Club instead of a parade. Anderson informed Council the Saddle Club gave the Bates County Memorial Hospital proceeds of $2,000 last year which will be used for the free mammogram program at the hospital. Council approved the request and the Butler Police Department was given a copy of the route of the walk/run or ride which will take place on Saturday, June 20th beginning at the Butler Fair Grounds.

Josh Hagberg, Butler Alumni President came before Council to ask permission for the alumni parade this Saturday, May 23rd. When asked, Butler Police Chief Randy Beshore said all he could do would be to post it, the Department likes at least 2 weeks before an event to line up the personnel to work the parade.

Casey Koehn, Butler City Administrator told Council that she and Elizabeth Ogg, Bates County Economic Developer, held a conference call with MC Power regarding the two signs currently on the highway but not being used to our advantage. She presented two preliminary drawings regarding the signs but nothing has been decided and she would update at a later time.

Brad Vermaas, representing First Baptist Church asked permission to use part of the Butler Fair Grounds to shoot an upcoming drama film. It will be close to the brush pile and a walk through will be on May 30th and the filming itself will be on Saturday, June 6th. He also informed Council that they would be shooting a gun loaded with blanks during the filming and wanted everyone to know this in case anyone became alarmed. Chief Beshore said he would let his department know what was happening but since it was on a Saturday, no children playing ball should be in the area. Councilman Vermaas also expressed his appreciation to the Police and Electric Department for their quick response when a 70 foot tree fell on a neighbor’s property.

Butler Police Department applied and received a $1,000 grant from Enbridge Pipeline.

Periodical Cicadas Emerging In Parts Of Missouri

COLUMBIA, Mo. – This could be a noisy summer for southeastern and western Missouri. A brood of 17-year periodical cicadas will emerge in northwestern Missouri (Kansas City and St. Joseph), and a brood of 13-year periodical cicadas will surface in southeastern Missouri (Cape Girardeau).

Wingless nymphs will come out of the ground, climb up on objects (trees, sheds, homes), break out of their exoskeletons and emerge as winged adults. They’ll take to the trees and sing, sing, sing, sing.

The periodical cicadas have one job only—to mate. Prior to this free-for-all mating event, cicadas have spent years underground.

They live underground for 13 or 17 years in the nymphal stage, feeding on tree and plant roots, Barrett said. When the adults emerge they look very different from the annual, or dog day, cicadas.
cicada1

They are easy pickings for predators, but they come out in such large numbers that they overwhelm all the natural enemies, Barrett said. The birds, mammals and fish that feed on cicadas eat as much as they can, but there are still so many left. It’s a process called predator satiation, he said.

The noise and numbers can seem overwhelming, but they won’t be around for very long. They’ll peak around mid-June and then once they reproduce, once they do what they’re programmed to do, they’ll die. Then you won’t see them again for another 13 or 17 years.

Two Arrested in High Speed Pursuit

On 5/18/15 the Butler Police Department received information regarding a stolen 2013 Audi that was in the Butler area. The vehicle was seen leaving the city on Rice Road. A Bates County Deputy saw the vehicle returning to the City of Butler on 52 Highway at Interstate 49 Highway. The Deputy activated his lights to stop the vehicle at the 52 and 49 intersections. The vehicle then pulled to the side of the road until the Deputy exited his patrol vehicle. When the Deputy exited the patrol vehicle, the driver of the stolen Audi took off and traveled north on Interstate 49.

The Deputy gave chase north on I49. Information was then provided by Kansas Authorities that the vehicle was taken during a residential burglary and that the driver was a documented violent gang member of the “Satan’s Disciples”. The driver of the stolen Audi had a long criminal history to include weapons violations, thefts and aggravated assaults. Additional units from Butler Police Department and the Missouri State Highway Patrol joined into the pursuit. A request was sent to the Archie Police Department to deploy spike strips at Archie. The Audi was able to avoid the spike strips at Archie but was subsequently spiked north of Archie by another unit. The Cass County Sheriff’s Office also spiked the subject just south of Harrisonville. After the second spike strips the Audi then had blown the two front tires but continued to travel north on I49. During the pursuit the driver was observed opening his door and dumping what appeared to be a white powder and at one point tossed what was believed to have been a gun.

The Audi exited off at the Commercial Street exit in Harrisonville and continued north on Commercial Street. The Audi then made a turn in behind the CVS Pharmacy and attempted to exit onto Mechanic Street. Due to not having any traction on the front tires the car slid across the road into the curb of the Price Chopper parking lot. Deputies from the Cass County Sheriff’s Office, Bates County Sheriff’s Office, Troopers from the Missouri State Highway Patrol, Police Officers from the Harrisonville Police Department and the Archie Police Department converged onto the vehicle to take the subject into custody.

The Driver was transported by ambulance to the Cass County Medical Center for treatment from a Police K9 bite. The female was transported to the Medical Center for abdominal pains believed to have been caused by the car striking the curb. After both subjects were released from the hospital they were transported to the Cass County Sheriff’s Office.

Both subjects, who are identified below, were transferred to the Bates County Sheriff’s Office and are currently still in custody.

Michael S Rojas (DOB 11/11/1974) of Kansas City, MO was charged with Possession of a Controlled Substance except 35 grams or less of Marijuana, Tampering with a Motor Vehicle and Resisting Arrest/Detention/Stop by Fleeing creating a substantial risk of serious injury or death to any person. His bond was set at $1,000,000.00 cash or surety.
